Perhaps you own a vacation home or second residence in the Sunshine State, but are still domiciled up north. If you’ve already invested or are considering purchasing real estate in Florida, please join us in a review of the important legal issues to consider. Title Considerations Every situation is different so it’s imperative to carefully consider your personal situation. The most common means of holding property is through individual ownership or Tenants by the Entireties if you are married. Will the home be for personal use? Or do you plan to rent the property? The best course of action for each scenario is unique and will also result in very different risk management issues effecting potential higher insurance premiums. Homestead Exemptions Florida provides its residents with very generous homestead protections and exemptions, but also restricts the ability to transfer the homestead. If your new home will be your primary residence, all documentation evidencing Florida domicile must be dated on or before Dec. 31st. Once your new homestead is approved, the “Save Our Homes” exemption is another incentive that saves Floridians an enormous amount of money each year. The potentially complicated waters of transferring your homestead from another state are best navigated with a professional advisor. Condo Commandos Beware of dog – or many cases the community home owner’s association (they do bite). Florida is notorious for overzealous HOA’s, so it’s important to read all the fine print about your new community before the closing date. Aside from fees for the upkeep of common areas, rules can range from parking restrictions to pets to the color of your mailbox. Failure to pay HOA dues can ultimately result in the association placing a lien on your property.

Strategies could include having items moved to local storage in Cat5 Buildings (structures built to Miami-Dade Code). The same applies for boats and yachts moored behind the home on a boat dock/lift. There must be a contingency plan in place to protect these valuable assets.

Home Prices Cool as Inventory Climbs in November

Naples, Fla. (December 26, 2023) – Overall inventory of homes in Naples for November increased 38.8 percent to 3,795 properties from 2,734 properties in November 2022. Buyers have not enjoyed a level of choice since September 2020. The month also included 1,080 price decreases resulting in a 3.3 percent decrease in overall median closed price. According to the November 2023 Market Report by the Naples Area Board of REALTORS® (NABOR®), which tracks home listings and sales within Collier County (excluding Marco Island), data showed the housing market is poised to enjoy healthy winter sales, but it will depend on whether sellers continue to price their homes to sell and whether buyers feel the investment is right. “A lot of the underlying foundation that drives the real estate market is in place,” said Budge Huskey, CEO, Premier Sotheby’s International Realty. “The primary obstacle to overcome is a residual feeling by buyers that things feel more expensive than they once were due to inflation, and this hesitancy is being translated to real estate.” The November Report showed 1,080 price decreases, the highest in six months. Price deceleration may be happening in parts of Naples as the overall median closed price dropped to $580,000 from $600,000 in November 2022. As such, November was one of four months this year that reported a decrease in median closed prices. In fact, year-over-year price decreases have not been reported since 2019. According to Mike Bone, Area Sales Manager with D.R. Horton, “Area builders have experienced a much slower fall sales market than what was budgeted for the fall months. Sales were lagging behind monthly budgets by approximately 25 percent, and cancellation rates on contracts have hovered around 20 percent due to the higher interest rates.” Pending sales (homes under contract) in November decreased 13.8 percent to 661 pending sales from 767 pending sales in November 2022. Closed sales also decreased by 6.1 percent to 537 closed sales from 572 closed sales. Responding to this data, broker analysts reviewing the November report wonder if the Federal Reserve’s promise to lower rates in 2024 may be keeping some buyers on the fence.

I am often asked if you had to pick one lesson that would help everyone universally, what would you choose? The answer is easy, Grip Pressure. Having the proper grip pressure, I feel is the most important element of the golf swing. If you hold club too tight, you loose complete feel for the golf swing and throws off your timing and tempo. Teaching the fundamentals, grip, stance, ball position and alignment are fairly easy, compared to teaching the proper grip pressure. I try to explain it by comparing it to holding a child’s hand crossing the street. You have control of it, he’s not going to run into the street, but you’re not hurting him. Have you ever heard someone say. “I hit the ball great on the range, but cant take it to the course?” When you are on the range, there is no pressure, you have a basket of balls, there is no consequences. Basically, you are relaxed. Then we proceed to our game on the first tee. Out of bounds left, water right. We automatically tense up. And the first thing to tighten is your grip on the club. Once your hands get tight on the club that will lead to your arms, then shoulders, then your lower body. This tension throughout your body, greatly changes the flow of the golf swing and effects you’re timing and tempo. When timing and tempo is altered the release of the club will be altered leading to errant shots. So what can I do to check my grip pressure? First, breath! Simple enough but good deep breathing reduces tension. Second, make a conscious effort to hold the club soft. You should be able to feel the club head at the end of the shaft. Third, try and stay in constant motion before swinging. You will never see a good player stand stagnant over the ball for any length of time. Waggle the club, keep your feet moving or hover the club above the ground. All of these will help reduce tension from creeping in.
